Summary: Its not always easy when you're handling the case of a dead cop.
Author's Note: Next chapter. I've introduced some more characters, so again, if you need help with who the characters are, I have reference posts for both CSI:NY and Conviction. If you have a question, don't be afraid to ask, I don't mind answering.

“Sharp is doing what?” Danny asked as he and Lindsay settled into a pizza place not to far from the DA’s office.

“Putting Flack on the stand for some reason,” Lindsay she replied, “Neither Flack nor Peluso know why.”

Danny sneered, “This is typical. Why the hell they picked Peluso of all people to handle this case is beyond me.”

“He’s a good attorney, Danny,” Lindsay stated evenly, knowing clearly how Danny felt about this.

“He may be a good attorney, but he was an idiot. Did you see the way he almost let a cop killer go, or do you just not care because you didn’t know the vic?”

“That’s not fair,” Lindsay stated softly.

Danny shook his head, “Sorry. It’s just that last time, he had such a slam dunk case, and he nearly blew it.”

“There hadn’t been barely any forensic evidence collected. The case should have never been given to him in the first place based solely on eyewitness testimony.”

“But he had an eyewitness,” Danny replied, “And he was willing to screw his case because of a little discrepancy.”

“Discrepancy? The man lied on the stand, Danny! Peluso could have lost his job if he didn’t say something and the defense found out about it. And he did manage to cover his ass and get a conviction in the end, and that’s what matters.”

Danny closed his eyes for a second, took a deep breath, and nodded, “You’re right. You’re right. It’s just—this whole thing is making me really nervous.”

“You’re not the one who has to testify,” Lindsay commented.

“Mac is probably going to have me working the entire week so that I don’t show up at the courtroom and kill the piece of scum. Probably why Sharp picked Flack instead of me. I wouldn’t care about being arrested for contempt.”

“You’re saying Flack would?”

“No—It’d probably just take a lot more to piss him off,” Danny said, looking down at the menu, “But that’s not why we’re here, right? Let’s just drop it.”

Lindsay looked up at him, before looking back down at the menu again. She knew there was more he wanted to say, but if he wasn’t going to talk about it, she wasn’t going to pry. Besides, she really shouldn’t be talking to him about the trial anyway.

“Pepperoni sound good?” he asked, glancing at her over the top of the menu.

“Perfect,” she said, and he gave her a smile. The waiter came to take their order, and once he was gone, he leaned on the table.

“Alright, Montana,” he began, “Let’s talk.”

Brian was leaning over the file in front of him when there was a soft knock on the door. He looked up and saw Billy Desmond standing in front of him, a sober look on his face. “After I saw the witness list, I called Sharp to ask him what in hell he was doing putting Flack on the stand.” He paused for a second, coming in to sit in the chair across from Brian’s desk, “He says it’s to call to the character of the victim, just like Flack suspected. I think there’s something else to this to.”

“You mean other than the fact that he wants to tear Burn apart?” Brian said, arching an eyebrow in the man’s direction.

“I think he’s going to try and spin this on Flack,” Billy sighed, “Make it look like he was responsible for not catching Aiden before she started practically stalking Pratt.”

“How is he going to do that? All of her friends were clueless on this one.”

“Well, the rumor mill says that they were sleeping together,” Billy replied, “If he was in her apartment, Sharp’s probably going to argue that there was no way he could have missed the mini lab she was hiding in her living room. But he must have concrete evidence of that fact that we don’t know about.”

“I put in a motion to strike him as a witness, and I have to argue it tomorrow,” Brian sighed, running a hand through his hair, “Hopefully, we can keep him from taking the stand at all.” He leaned back in his chair, a stressed look on his face, “She’s dead, and she’s still a pain in my ass.”

Billy chuckled. Brian and Aiden fought like cats and dogs whenever he had to prep her for the stand, but it was more of playful banter than the fact that they full out hated each other. But they really had gone head to head over the Pratt case the last time Brian and Jess took him to court. All the prepping in the world, wasn’t going to get Regina Bowen on that stand, and they needed that for a conviction, but that didn’t stop Aiden from taking it hard. She had been on Brian’s back since then, but her actions weren’t helping matters at all. But Brian understood where she was coming from at least.

It wasn’t entirely unexpected when Peluso insisted on trying her case. She was a friend after all. Billy was happy he at least got to make second chair on this. This case was high profile enough as it was. But Aiden’s actions over the past year weren’t helping her case any. It was disgraced NYPD cop versus accused rapist, and Sharp knew enough loopholes and traps to actually get this dismissed.

Brian leaned forward, resting his elbows on the desk, and his chin in his hands, “I’m thinking about putting Regina Bowen on the stand.”

“That’s a bit of a risk, Peluso,” Billy said, somewhat worried.

“If we put the original victim on the stand, and convince her to actually testify this time, maybe we can get a little more sympathy for Aiden and what she was trying to do,” Peluso said, weighing the options in his head.

“That’s a pretty big maybe, and a pretty big chance of letting Sharp tear her apart,” Billy replied, “Are you really sure you want to do that?”

“We’d have to prep her really well,” Brian sighed, “I took a pretty big risk on her the last time, but she considered Aiden a friend. Maybe there’s something we can dwell on there to keep her on the stand.”

Billy didn’t like this risk. He didn’t like it at all.

“Go, talk to her tomorrow, see if she’s even willing to testify at all. I have to go and see if I can prove to the court that having Flack on the stand is a waste of time.”

Billy nodded, before getting up to leave, and instead of heading straight out the door, he walked to the other end of the office, where Jessica Rossi was still working. She looked up when she heard him enter, and gave him a half smile. “What do you need, Desmond?”

“I know the last thing you want is to be involved in this case,” he began, “But can you come with me to talk to Regina Bowen tomorrow?”

“I would, but I’m in court all day,” she replied, “Peluso wants to put her on the stand?”

“Yeah,” Billy nodded, “I’m not so sure she’ll do it.”

Jess hesitated for a second, before nodding, “I think she will.”

Christina's coming...eventually. these pieces are more centered on the case, but christina will come into play.

and i'm glad you like it. it's a lot of fun for me to write, because i really think these two sets of characters would interact together really well.
