Summary: Its not always easy when you're handling the case of a dead cop.
Author's Note: OK, first in a series of fics circling around DJ Pratt's trial for the murder of Aiden Burn. If you need help with who the characters are, I have reference posts for both CSI:NY and Conviction. If you have a question, don't be afraid to ask, I don't mind answering.

Danny wanted a fresh start. He wanted a chance to start over and try and work this out. Lindsay wasn’t so sure that was what she wanted. Her feelings were all over the place, and with the Pratt trial coming up, she really didn’t need her head to be pulled in twenty different directions. Pratt was a total scumbag, but his lawyer was worse. And to top that all off, he was good. She couldn’t afford to slip up on the stand because it might mean the difference between a solid conviction and reasonable doubt.

She knew that she hadn’t exactly handled things the right way after the case with the Hollies. After they smoke cleared and things went back to the way things were supposed to be, she was so confused that she didn’t know what she was doing. Danny asked her to have dinner with him, and she couldn’t say yes. She knew she couldn’t possibly be what he wanted, so there was no way she was actually going to put herself in that situation and let herself get hurt.

“Lindsay?” Brian Peluso’s voice came from in front of her, and she looked up. “You alright?” He looked concerned. She usually wasn’t this out if it, she knew that, but she was finding it insanely hard to just focus.

“Fine,” she shook her head, “I’m fine.” Brian wasn’t convinced. He had seen that look on himself many times, and he knew when someone was distracted by matters of the heart. His problems were somewhat similar to hers. Unrequited love was a bit of a bitch. But if she said she was fine, he wasn’t going to push. He just hoped it wasn’t going to mess with his case.

He started firing off questions again, and she answered them, well at first, but then that slowly deteriorated into her mind being elsewhere again and he had to stop. Her mind had slipped off to Danny-land once again.

She couldn’t figure out his motive. Why he wanted her of all people. She wasn’t sophisticated, or gorgeous, or some fashionista, she was just Lindsay from Montana, and she was normal. She wasn’t Aiden Burn. She didn’t understand why he would want to shoot for lower than he had had. But while she was off trying to figure Danny out, Brian was starting to get frustrated.

“Look, Lindsay,” he said, sitting down across from her, “I know that you’re probably under a lot of stress right now, with the whole hostage thing that happened last week, and believe me, I know. It’ll fuck with your head. But I really need for you to focus right now. You’re the most stable witness I’ve got.”

He knew that Stella and Mac were too close to Aiden for the defense attorney not to attempt to say their testimony was prejudicial. Plus, they were involved with the prior trial against Pratt, and they fact that they lost was no fault of their own, but if Jackson Sharp wanted to turn this case into a vendetta against his client, he would do it, and Brian didn’t want that to happen. That’s why Lindsay needed to bring her A-game, and right now, Brian wasn’t so confident she could do that.

“Are you sure you’re OK?” he asked.

“Yes,” she stated, and he didn’t believe her any more than he had any other time.

“You know what,” he said, placing his hands, palm down, on the table, “Let’s take a break.”

“Peluso, I’m fine.”

“I have to pick up the defense’s witness list anyway,” he replied, getting up, “Let’s take a break, I’ll pick up the list, you make a phone call, and I’ll be right back.”

“What makes you think I need to make a phone call?” Lindsay asked, somewhat amused that he just made that assumption out of no where.

“I just do,” he replied before leaving the room. She took a deep breath before pulling out the cell phone and doing as he said.

“Messer.”

“Hey Danny,” she sighed, “It’s me.” She didn’t know what she was doing. All she had wanted to do after that whole mess was over was just run to him and let him take her away, but there was so much between them in the past year that she wasn’t so sure she could do that. There were so many complications.

“Montana,” he said softly, and she could hear the smile in his voice, “What can I do for you?”

“You said you wanted a fresh start right?” she said a little hurriedly. Maybe if she just gave into this, it would clear her head. Balance would be restored, life would be better, and she wouldn’t have to worry about Danny finding out about her crush on him like a high school teenager. But it was her sudden about-face from her firm no this morning that was throwing him off.

“What are you doing, Lindsay?”

“I don’t know,” she admitted, resting her head against her forehead, “I don’t know but I can’t think straight, and Peluso’s getting frustrated with me, and I have no idea what I want, but I think it has something to do with you and us, and I have the biggest feat I’m going to blow this case, and I don’t want that to happen.”

“Alright, Linds, calm down,” he sighed. Words were coming out of her mouth a mile a minute, and he wasn’t sure whether or not she meant them or that she even knew what she was saying. “What do you want to do?”

She felt like she was sounding like a broken record, because she could think of nothing better to say. “I don’t know.”

“Why don’t I pick you up after you’re done with Peluso?” Danny suggested, “We’ll grab a bite to eat and we’ll talk, alright? Just talk.”

She closed her eyes, took a deep breath, and willed herself to sleep. “Alright. Just talk.”

“OK. Call me when you’re ready.”

“I will.” They both hung up, and she stared at the phone in her hand like a heavy weight had just been lifted off her shoulders. She wasn’t completely comfortable, but she didn’t feel like what ever was going on between her and Danny was suffocating her, and she could actually think again. She was getting ready to go and find Peluso, but she then realized that wasn’t going to be necessary.

“WHAT?!?!?” She heard his voice echo from somewhere in the office. She followed the echo until she found Flack sitting next to the secretary’s desk, his elbows resting on his knees, and Brian pacing frantically.

“Why would he do that? What information can he get by calling you to the stand?”

“He didn’t tell me much, but it might have to do with calling Aiden’s character into question,” Flack replied, “He says if necessary, he would clear it with the judge to treat me as a hostile witness.”

“He’s already subpoenaed you?”

Flack nodded slowly, and a hushed “fuck” escaped Brian’s lips as he pinched the bridge of his nose, “He’s turning this into a fucking self-defense case.” He looked up and saw Lindsay, and she gave him a look.

“What’s going on?” Lindsay asked, and Flack looked up at her with a frown.

“Sharp’s putting Flack on the stand,” Brian sighed, looking somewhat exasperated, “Lindsay, I really need your head to be in this right now.”

“It is,” she nodded, “I fixed the problem.” Brian nodded, before turning to Flack, “We’ll handle this, alright? I’ll put in a motion for—something, and try and get you out of it, but if we don’t, don’t worry about it, alright?” Flack nodded, before getting up to leave, and Brian turned to Lindsay. “C’mon. Let’s get through the rest of those questions.”

I sorta wanted to check out Conviction because of the Angel tie-in with J August Richards,(there were jokes flying around the fandom about Billy being Gunn and Wolfram and Hart, the Angel lawfirm being involved...Gunn died in the last Angel ep but people were always coming back to life in that fandom.it was kinda funny sometimes lol. And still needs a fic, if I get around to it.) but never got the chance :( Anyway, this is a good start. Keep it up, I need more lol.

You know, I never even watched Conviction, but following along with the refernce thing you made up, I sort of have an idea of who's who (I'm trying to recall from memory, at the moent, of what these people sounded like).

Anyway. Loved this part and I can't wait for another one.

cuz most of the people reading them are conviction fans who have no idea about csi:ny and vice versa. i'm glad that there's someone reading them who likes both!

and i'm adding you back.
