Summary: The CSIs try and come up with a plan to arrest Mirimoto with the kappa.
Author's Note: This was probably the hardest part to figure out, which was also the hardest part for them to figure out.

The animal being prodded back into the cage was not a large one by any means. In fact, it probably wasn’t any bigger than a small child. But Dean knew exactly what it was and how much damage it could do. He just hoped that the man pushing the animal back into the cage hadn’t heard what he said. He ducked back pulling himself from view as the man looked around, before slowly making his way up the stairs and back towards the first floor. He quietly shut the door behind him, before dashing across to the bathroom and shutting the door behind him.
“What’s taking your partner so long?” Mirimoto asked Calleigh, and she shrugged.
“He’s like this everywhere we go. Can’t seem to hold it for two seconds, and then takes a half hour in there taking care of business. He’s worse than me.”
There was the sound of a flushing toilet and the water running, before Dean emerged from the bathroom, wiping his hands together.
“Sorry that took so long,” he said, “You might not want to go in there for a while—it wasn’t pretty.”
“Thank you for the warning,” Mirimoto replied between clenched teeth.
“Well, now that that’s taken care of, do you have any other questions for Mr. Mirimoto?”
“No, I’m confident that you covered everything,” Dean nodded.
“Alright, then,” Calleigh nodded, “Then we’ll get out of your hair. Thank you again for your time, Mr. Mirimoto.”
“Anything I can do to help, Officers,” he replied, teeth still clenched as he walked them out the door. Calleigh and Dean proceeded back to the Hummer, but didn’t talk until they had both slid into the vehicle.
“So what did you find?”
“They’re is keeping a pet kappa in a cage in the basement,” Dean replied, “And I use the word ‘pet’ loosely.”
“So they’re our murderers.”
“Yup.”
“So how do we get this to hold up in court?” she mused to herself, and Dean shrugged.
“That’s not my problem,” Dean sighed, “I just take kill ‘em, I don’t worry about how to prosecute ‘em.”
“Dean—” she hesitated slightly, turning to look at him, “You think there’s a way we could get out of this without killing the kappa?”
He turned to her and quirked an eyebrow in her direction, “You getting soft in your old age, Duquesne?” She swatted him on the shoulder and he grinned at her before continuing, “The thing has killed at least five people, Call. You would do the same thing to a dog if it went psycho and mauled someone.”
“Yeah but—a kappa’s a bit smarter than a dog, you know that.”
“Calleigh—” he sighed, turning to face her, “—I’ll do my best, alright? But I can’t promise anything.”
“That’s all I ask,” she said, giving him a small smile, before putting the car into gear.

“So how do we do this?” Natalia asked, “How do we get a search warrant for this?”
“I don’t know,” Calleigh sighed, “But we know that they have the murder weapon, we just have to get probable cause to search the house and legally find it.”
“Their tire treads match the ones found at the scene,” Eric sighed, “They have been trying to buy the land for years, and that gives them motive. What are we missing?”
“What I think you’re missing is how they’re getting this thing to do what they want to begin with,” Dean’s voice came from the corner, where he and Sam had been sitting, watching the four criminalists work.
“Well, you said they had it in a cage or something against its will,” Ryan replied, turning to face them, “If they let it loose on the family, angry like that, it’ll probably have attacked the nearest thing they let it loose on.”
“No, Dean’s gotta point,” Calleigh sighed, “Kappa’s don’t work the same way a dog would. They’re almost human in their mentality. They don’t just lash out unless they’re malicious or they’re protecting—” She looked up and realization, “—something or someone.”
“Calleigh?” Ryan asked, “Care to let the rest of the group in on this?”
“That’s why the Mirimotos returned to the scene. They had left something behind.”
“What?” Eric asked.
“Bruce!” Sam said, suddenly reaching the same realization.
“Who?” Natalia frowned.
“The baby kappa we found at the scene,” Calleigh explained.
“I named him Bruce,” Sam added.
“The kappa sitting in the Mirimotos’ basement must be his mother,” Calleigh explained, “And they would hide him in the house, and the bigger kappa would tear the place apart trying to find it.”
“How does any of that get a search warrant?” Ryan asked.
“I don’t know,” Calleigh sighed.
“Well, me and Sammy don’t need a search warrant to go in and get the thing,” Dean replied with a smirk, “And we probably shouldn’t be telling a room full of cops this.”
“So how would that help us?” Ryan said, “In fact, that would keep us from proving our case.”
Dean looked at Calleigh for a minute, and she looked back before shaking her head. “I can’t just make this go away, Dean.”
“Chalk it up to a gator attack, Sam and I get rid of the kappa, the world’s a better place.”
“We’ll be leaving a murderer on the street.”
“But you’ll be taking the murder weapon out of his hands,” Sam replied, “If you can’t find enough evidence for a warrant, that may be the best you can get.”
“How do we know he won’t trap another one?” Eric replied, “And then use that to attack people.”
“Maybe he’ll actually get a hold of the land with the house this time around,” Dean pointed out, “And there won’t be another attack.”
“That’ll be like rewarding him for killing all those people,” Natalia replied, “He’ll be getting away with murder.”
“I’m sorry, Dean,” Calleigh sighed, “But I don’t think we can do that.”
“Suit yourself,” Dean sighed, “Me and Sam are gonna be the ones getting rid of the thing anyway, so doesn’t matter if we get it before or after.”
“Don’t these things speak Japanese?” Sam asked, “The kappa itself could be a potential witness to your case.”
“We still have to get it out of the house to verify all that,” Natalia sighed, “And the DA’s office isn’t going to like this.”
“If there was a way we could get them to get it out of the house and have it in plain sight,” Calleigh sighed, “Some kind of bait—”
Sam paused for a minute, “Like Bruce?” Dean looked at him, and shook his head.
“I can’t go back to that house out in the open, or else they’ll never let it anywhere near you.”
“Well, I wasn’t thinking you,” Sam replied, “He doesn’t like you anyway.” Dean rolled his eyes and Sam turned back to the CSIs. “If Bruce really was the bait for this whole thing, and they see me out on the street with him, why wouldn’t they send the bigger one out on me to try and get him back?”
“Problem,” Ryan replied, “What if they don’t, and they come out and try to claim him themselves?”
“If they claim to own Bruce, would that give you enough probable cause for a search warrant? Something of theirs that they left behind at the crime scene?” Sam asked, looking to each of the CSIs.
They all turned on him in surprise. Natalia was the one that spoke first, “He’s—right. That could work.”
“How’d you—” Ryan began.
“I was pre-law at Stanford,” Sam replied.
“Well—either way, we’ve pretty much got them,” Calleigh nodded, “Now Dean and I can’t go back, but if someone else was to go with Sam—”
“I don’t need—” Sam started, and Dean elbowed him in the side.
“I’ll go,” Natalia spoke up.
“Alright,” Calleigh nodded, “Let’s get this guy.”
