Content Warning: Spoilers for "Heroes," "Charge of this Post," "Hostage"
Summary: Its not always easy when you're handling the case of a dead cop.
Author's Note: I felt that this fic was lacking in Flack/Jess. This chapter may not really be necessary, but I like it.

Flack’s leg jittered nervously as he sat at his desk, staring at the clock on the wall. Jury had been out for three days already, with no sign on whether or not they were anywhere close to reaching a verdict. He wanted this thing to be all over and behind them, but the jury seemed content to take their sweet time in deciding whether or not the man was guilty. In Flack’s mind he already was, and the jury was just doing this to torture them in some way, shape or form.
He felt a hand land on his arm and he turned suddenly in surprise, in time to see Jess jump back slightly, a look of surprise on her face. “Easy there, tiger,” she grinned, and he shook his head.
“You scared the shit out of me,” he murmured before giving her a smile, “Don’t do that again.”
“You are far too wound up,” she shook her head, before he felt her slide behind him, her fingers starting to dig into his shoulders. He let out a soft groan, leaning back to look at her.
“This really isn’t the place to be doing this,” he murmured.
“Why? Your cop buddies gonna make fun of you?”
“Yes,” he grinned and she laughed.
“You need to relax a little though,” she sighed, coming around to sit on the edge of his desk, “When do you get off?”
“I’ve got another hour,” he replied, and she gave him a grin.
“I can wait. Your place or mine?”
Flack pondered it for a second, before his grin widened, “Yours.”
“Alright,” she said, before backing away from his desk, “I’ll see you then.”

“This case really wound you up, huh?” she murmured to him later, his head burrowing into her shoulder as he pulled her closer. The process of helping him to unwind had started practically the minute he walked in the door, and now they were just enjoying each other’s company more than anything else.
“She was my friend,” he replied, “Can’t help it.”
“Mmmm,” It was a slight sound of agreement, and she was running her fingers through his hair lightly. “Well, it’ll all be over soon.”
“What if it’s not?” he said, looking up at her with slight fear in his eyes, “What if something happens, and he’s found not guilty?”
“That’s not likely to happen,” Jess sighed, “At least found completely not guilty anyway.”
“Whadaya mean?” Flack frowned.
“Well, the thing you don’t want to happen is for them to find him not guilty,” Jess replied, the two of them shifting so that she was facing him, “Because then double jeopardy gets attached and you can’t retry him if you find new evidence.”
“So what else is there?”
“Well, there’s a hung jury,” Jess sighed, “Which is when the jury can’t reach a unanimous verdict, and we have to retry. It’ll just take a little longer.”
His head hung slightly, “I don’t know if I could do this all over again.”
“You won’t have to,” she whispered, “They’ll find him guilty.”
“You sure?”
“Extremely,” she said, before inching so that she was closer to him, “I heard this nasty little rumor today.”
“Really?” he said, shifting so that he was on top and she was lying under him, “What’s that?”
“That you have a day off tomorrow.”
“That I do,” he smirked before leaning in to kiss her gently, “I’m not even on call.”
“I happened to swing some time off as well.”
“So you mean we have the entire day to ourselves tomorrow?” Don said, pulling back slightly and looking down at her.
“Yup,” she grinned.
“You just made my day,” he grinned before leaning in to kiss her again.

Don fumbled on his nightstand when he heard the phone ring the next morning, and didn’t even open his eyes before answering, intending on going right back to sleep after the call was over. “Flack.”
“Were you asleep?” Danny’s voice came back to him in confusion, “It’s almost noon.”
“Me and Jess both have the day off,” he replied, “What do you want?”
“Jury’s back on Aiden’s case.” Flack really woke up at this point, and felt Jess stir next to him.
“We’ll be right down,” he said into the phone before hung up, and then turned to her.
“Danny?” she asked, and he nodded.
“The jury’s back.”
“Well, this is it,” Jess sighed, “Let’s go.”
